A Malaysian national, Mr Lee Kar Choon, was riding his motorcycle along Admiralty Road West towards his workplace when a tree branch along the road fell and caused him to be flung off his vehicle. He lapsed into a coma due to the impact and was later admitted into the hospital where he was found to have sustained serious head injuries. Lee currently remains in a vegetative state and continues to receive treatment in Ipoh.
Lee’s wife and sister is now seeking damages against NParks for pain and suffering, medical costs and loss of earnings on behalf of Lee. Their claim is on the basis of alleged negligence on the part of NParks for failing to conduct regular pruning exercises of trees so as to reduce the dangers to road users, and also that NParks had failed to remedy or warn of the dangerous conditions that it should have reasonably known to be existing at the location.
Lee is represented by our lawyer, N. Srinivasan and a High Court pre-trial conference has been scheduled for later this week.
